Terms of Use

1. Description of the Services

SwapX is an online face swap application that uses artificial intelligence to generate content. No registration is required to begin using it.

• Upload. You upload a photo, image, GIF or video containing faces from your device, in a supported format and file size ("Uploaded Content").
• Swap. Our AI processes the media and produces a new photo or video with the face replaced ("Generated Content").
• Share and download. You may save Generated Content to your device or share it through the options offered by the Application or your operating system.

SwapX reserves the right to change the scope of the Services, and to introduce or change prices and fees, at any time and without notice. We may restrict or discontinue provision of the Services, in whole or in part, to any user, and may discontinue provision or support of the Services without prior notice.

2. Purchases, subscriptions and refunds

Credits and Pro features

The Application is free to download and includes a starting allowance of credits. Additional credits may be purchased as one-off packs, and premium functionality ("Pro Features") is available through a paid subscription. Prices are displayed in the Application at the time of purchase.

Subscription plans and renewal

Subscription Plans may be offered on a weekly, monthly, three-monthly or annual basis. Which plans are available may differ by marketplace, at our sole discretion.

Your subscription period begins as soon as the initial payment is processed. Subscriptions renew automatically at the same term and fee unless cancelled. By activating a Subscription Plan you authorise us to charge your payment method for each renewal term.

Cancelling

Subscriptions are managed by Apple, not by us. Cancel through your App Store account settings: Settings → your name → Subscriptions → SwapX → Cancel Subscription. You will not receive a prorated refund on cancellation, and you retain access to Pro Features until the end of the period already paid for. Charges incurred before cancellation remain payable.

Free trial

Where offered, a three-day free trial is available on the Annual and 3-Month Subscription Plans. The Weekly and Monthly plans have no trial period. Exact trial terms are shown in the Application at the moment of activation. Unless you cancel at least 24 hours before the trial expires, the subscription fee will be charged automatically.

Price changes

Fees and other subscription terms may be revised at our discretion. We will notify you reasonably in advance of the effective date, and you may cancel if you do not accept the revision. Subject to applicable law, continuing to use the Services after the revision takes effect constitutes acceptance.

Refunds

Fees may be refunded where required by applicable law or under the refund terms of the Apple App Store. In addition, you are eligible for a refund within 48 hours of a validated purchase if you are dissatisfied with the quality of the face swap. This guarantee does not apply to subscription renewals.

App Store refunds are requested through reportaproblem.apple.com. If something failed on our side — a render that consumed credits without producing a result — email us instead and we will correct your balance directly, which is usually faster.

3. Who can use the Services

You must be at least 12 years of age to access or use the Services. If you are under 18 (or the age of legal majority where you live), you may use the Services only under the supervision of a parent or legal guardian who agrees to be bound by these Terms. Parents and guardians of users under 18 agree to be fully responsible for those users' acts and omissions in connection with the Services.

By using the Services you confirm that: you can form a binding contract with SwapX; you are over 18 or using the Services under parental or guardian supervision; you are not barred from using the Services under the laws of the United States, the European Union or any other applicable jurisdiction; and you will comply with these Terms and all applicable laws and regulations.

Note: the Application carries a 17+ age rating on the Apple App Store, and separate minimum-age rules may apply through Apple.

4. Our content and your licence

The Services and the text, graphics, images, illustrations, trademarks, trade names, page headers, button icons, scripts and other content within them are owned by SwapX or its affiliates and are protected by copyright, trademark, patent, trade secret and other intellectual property laws. Except as expressly stated in these Terms, SwapX reserves all rights in and to the Services.

We grant you a limited, worldwide, royalty-free, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Services, for the sole purpose of using them as these Terms allow.

This licence does not include any right to: (a) sell or commercially exploit any part of the Services; (b) copy, reproduce, distribute, publicly perform or publicly display any part of the Services; (c) modify any part of the Services or remove proprietary rights notices; (d) reverse engineer or attempt to extract the source code of the software; or (e) use the Services other than as expressly provided in these Terms.

The licence does not cover template media owned by third parties and used by SwapX to provide the Services; use of those is governed by section 5.

5. Third-party content

The Services may contain links to third-party websites or services we do not own or control. You may also need a third party's product or service in order to use parts of the Services, such as a compatible mobile device. When you access third-party services you do so at your own risk, and those parties may require you to accept their own terms. SwapX is not a party to those agreements; they are solely between you and the third party.

6. Your content

You own and retain any rights you already hold in the content you upload ("Your Content").

Licence. By uploading, submitting, storing, sending or receiving Your Content through the Services, you grant SwapX a worldwide, non-exclusive, royalty-free, transferable licence to use, copy, modify, distribute, prepare derivative works based on, and display that content in connection with providing the Services to you.

Responsibility. You are responsible for the content you upload and for its legality, reliability, integrity, accuracy and quality. SwapX takes no responsibility and assumes no liability for content uploaded by users.

Consent. You must have the right to use every face you upload. That means your own face, or a face you have the explicit permission of the person to use. This is set out in full in our Acceptable Use Policy, which forms part of these Terms.

7. Privacy

By using the Services you consent to the collection and use of information as described in our Privacy Policy, including any data provided to us in connection with your use of the Services.

8. Prohibited activities

You agree not to use the Services to:

• violate any applicable law or regulation;
• infringe the intellectual property rights of others;
• use the Services for any illegal, harmful, fraudulent or malicious purpose;
• upload, submit or distribute content that is offensive, harmful, or unlawful;
• use a person's likeness without their explicit consent;
• create sexual or intimate imagery of a real person without their consent;
• create any sexual content involving a minor, or content that sexualises a person appearing to be a minor;
• create content designed to deceive, including fabricated evidence, impersonation, or material intended to influence an election;
• attempt to defeat facial verification, KYC checks or biometric authentication;
• harass, bully, defame or intimidate any individual.

9. Termination

We may terminate or suspend access to the Services at any time, without notice, for conduct we believe violates these Terms or is harmful to other users or to us.

10. Disclaimer of warranties

The Services are provided "as is", without warranties of any kind. We do not guarantee that the Services will be uninterrupted, secure or error-free, or that any particular swap will meet your expectations.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising out of your use of the Services, including data loss or service interruption.

12. Governing law and arbitration

These Terms are governed by the laws of the jurisdiction in which SwapX is established, without regard to conflict of law principles.

Any dispute arising from these Terms will be resolved through binding arbitration rather than in court. This does not affect any non-waivable rights you have under the mandatory consumer protection laws of your country of residence.

13. Changes to these Terms

We may revise these Terms from time to time. The most current version is always available in the Application and on this page.

These Terms apply to the official app AI Face Swap – SwapX on the Apple App Store and to swapxapp.com. They do not cover unofficial or repackaged builds distributed elsewhere, which we do not operate — see why that matters.
